Safety, Security, and Liability in Hotels

Hotels have a duty to exercise reasonable care for the safety and security of guests.  But what is “reasonable” is constantly under scrutiny from a legal perspective.  Safety and security issues result in liability concerns for hotels in three main areas: premises liability (slip and fall, defects in equipment and premises), vicarious liability (liability for acts and omissions of employees), and dram shop liability (alcohol-related issues).  In this interactive session, we’ll discuss some real cases that have occurred in hotels, in your jurisdiction and throughout the U.S., learning from the situations and mistakes of others in the hotel industry.  We will wrap up with what’s new on the safety, security, and legal horizon.  Forewarned is forearmed!

  • Develop policies and procedures to ensure that they reflect due care and due diligence toward hotel guests as well as others who may be in the hotel.
  • Implement hiring and training practices to minimize vicarious liability issues for the acts and omissions of employees that may result in liability to the hotel.
  • Mitigate risks and liability that may arise from the violation of state and federal laws include dram shop (alcohol) liability, Americans with Disabilities Act, and more.
